The Short Answer

Yes, wearing a body camera in the Philippines is legal for private citizens, guards, and workers, as long as you record in public or on premises you control and you follow the National Privacy Commission's 2025 body-worn camera guidelines on notice and data handling. What you cannot do is secretly record a private conversation you are not part of.

We get this question almost every week from guards, delivery riders, and small business owners eyeing the SJCAM A10 body camera. The short version above covers most people. But "it depends" is the honest full answer, so let us break it down the way we would explain it to a customer standing at our counter.

Public spaces are fair game

If you are standing on a street, inside a mall, at a terminal, or anywhere the public can freely go, there is no reasonable expectation of privacy. Filming what happens in front of you is legal. A tanod recording a disturbance, a rider capturing a road-rage driver, a saleslady documenting a shoplifter, these are all fine. The footage can even be used as evidence later.

Where people draw the line

The trouble starts with audio and with private spaces. Republic Act 4200, the Anti-Wiretapping Law, makes it illegal to secretly record a private conversation between other people if you are not a party to it. Recording your own conversation is a grey area, but recording two strangers whispering in a corner is not. And a body cam pointed into someone's home, a hotel room, or a comfort room crosses the line no matter what.

The new NPC rules you should actually know

In 2025 the National Privacy Commission issued Circular No. 2025-01, guidelines on personal data collected through body-worn cameras. In plain terms, if you or your company records people and stores that footage, you are handling their personal data. That means you should:

  • Put people on notice that recording may happen, a visible sign or a marked camera does the job.
  • Only keep footage as long as you actually need it, then delete it.
  • Keep the clips secure and not post random people's faces online for laughs.
  • Have a real reason for recording, security, evidence, safety, not idle spying.

These rules are aimed mostly at organizations and law enforcement, but the spirit applies to everyone. Record with a purpose, tell people when you reasonably can, and do not abuse the footage.

What about security guards and agencies?

Private security agencies are increasingly issuing body cams, and it is legal for them to do so. A guard wearing a camera at a gate, a bank entrance, or a subdivision perimeter is recording a space the agency controls, with a clear security purpose. Best practice is a visible "CCTV / body cam in use" notice and an internal policy on who can view and download clips. The A10's IP65 rain resistance and 6-hour battery is why a lot of agencies pick it for outdoor posts.

Does the SC body-cam rule apply to me?

Probably not. The Supreme Court's 2021 Rules on the Use of Body-Worn Cameras govern police serving arrest and search warrants. Unless you are a peace officer executing a warrant, those rules are not your concern. As a private user you fall under the general privacy and anti-wiretapping laws instead.

Quick real-world checklist

  • Recording a public incident? Legal.
  • Recording your own gate, store, or vehicle? Legal, ideally with a notice.
  • Secretly recording a private conversation between others? Illegal under RA 4200.
  • Pointing a cam into someone's home or CR? Never.
  • Posting a stranger's face online to shame them? Risky, and against the spirit of the NPC rules.

For most guards, riders, and frontline workers, a body cam is not just legal, it is genuinely protective. When there is a dispute about what happened, footage settles it fast. Keep your recording purposeful and your storage tidy, and you are well within the law.
